LI Man Gets 10 Years For Felony Drug Charges, Metal Knuckle Knife: DA
LINDENHURST, NY — A Lindenhurst man was sentenced to 10 years in prison on Tuesday, after he was convicted of possessing more than one half of an ounce of cocaine with the intent to sell it, as well as heroin, fentanyl, and a metal knuckle knife, Suffolk County District Attorney Raymond A. Tierney announced.
David Marmol, 41, was convicted by a jury on Dec. 2 after a week-long trial for charges of two counts of third-degree criminal possession of a controlled substance, seventh-degree criminal possession of a controlled substance, and fourth-degree criminal possession of a weapon, prosecutors said.
On Feb. 20, 2021, Suffolk County Police Department uniformed officers stopped Marmol for a traffic violation while he was operating a rented 2020 Ford Expedition in the vicinity of South Fifth Street and Montauk Highway in Lindenhurst, according to evidence established at trial.

When the officers approached Marmol’s vehicle, they detected an odor of marijuana emanating from inside his car. Officers then searched the car and recovered an illegal metal knuckle knife from the center console, prosecutors said.
Marmol was arrested and taken to the First Precinct, officials said. Officers further discovered him to be in possession of 20 bags of cocaine collectively weighing in excess of one-half ounce, as well as four bags containing quantities of heroin and fentanyl, prosecutors said.

In addition to 10 years in prison, Marmol was sentenced to three years of post-release supervision before Judge Timothy P. Mazzei.
Marmol was also previously convicted of fifth-degree attempted criminal possession of a controlled substance in 2010, second-degree robbery in 2001, and fifth-degree criminal sale of a controlled substance in 2000, prosecutors said.
“This defendant’s prior convictions for drug dealing did not stop him from again being caught with illegal drugs packaged for sale,” said Tierney. “Hopefully this prison sentence will serve as a deterrent to those who think about continued criminal activity. My office is committed to working with law enforcement to ensure dangerous drugs and drug dealers are kept off the streets of Suffolk County.”
The office of Peter Brill, Marmol’s attorney, declined to share a comment with Patch.
